1. OVERVIEW

This website is operated by Borgo ("we", "our", "us"), a sole proprietorship owned and operated by Blake Borgogno. By visiting our site or purchasing something from us, you agree to be bound by the following Terms of Service (“Terms”), including any additional terms, policies, and conditions referenced here.

If you do not agree to these Terms, do not use our website or products.

2. ONLINE STORE TERMS

  • You must be at least 18 years old or have permission from a parent or guardian to purchase from this site.

  • You may not use our products for any illegal or unauthorized purpose.

  • You agree not to misrepresent our products in resale or create confusion that your store is affiliated with or endorsed by Borgo.

3. SAFETY DISCLAIMER & ASSUMPTION OF RISK

By purchasing and using Borgoball or any Borgo products, you agree that:

  • You understand Borgoballs are not intended for children under 3 years of age due to potential choking hazards.

  • Borgoballs are made of soft foam but may pose a choking risk if bitten, chewed, or torn.

  • All use must be under adult supervision. Do not bite, chew, or place in mouth.

  • You assume all risk associated with the use or misuse of our products.

  • Borgo is not liable for any injury, damage, or claim resulting from unsafe use or use contrary to these guidelines.

4. PRODUCT RESALE POLICY

We allow the resale of Borgoball products under the following conditions:

  • You may resell genuine Borgoball products you purchased directly from us or from an authorized retailer.

  • You may not modify the product, packaging, or branding in a way that misrepresents the product’s origin or safety.

  • You must clearly represent that your store is an independent reseller and not officially affiliated with Borgo unless you have written permission.

  • Borgo reserves the right to revoke resale permission for anyone violating these terms or putting customers at risk.

5. MODIFICATIONS TO PRODUCTS & PRICES

  • Prices and product availability may change at any time without notice.

  • We reserve the right to discontinue products at any time.

6. SHIPPING & DELIVERY

  • We are not responsible for delivery delays caused by carriers or incorrect shipping information entered at checkout.

  • Risk of loss transfers to you upon shipment. If your item is lost or damaged in transit, contact us and we’ll try to help.

7. RETURNS & REFUNDS

  • We do not accept returns on opened or used Borgoballs for hygiene and safety reasons.

  • If your order arrives damaged or defective, contact us within 7 days. We may request proof (e.g. photos) before issuing a refund or replacement.

8. PERSONAL INFORMATION

Your submission of personal information through the store is governed by our Privacy Policy.

9. INTELLECTUAL PROPERTY

All content on this site — including product names, logos, videos, and images — is the property of Borgo. You may not use our content or trademarks without written permission.
